Shops and Establishments Act declaration format

A declaration by the owner of a shop, office or restaurant giving the details asked for when registering under the state Shops and Establishments Act.

This is a sample, not an official form. Offices differ. Check this text with the issuing office before you sign, and use the office's own form if it gives you one. Govt License does not give legal advice.

What it is for

Use it when the labour department asks for a declaration or undertaking with the Shops and Establishments registration or intimation. Choose your state and city: the format names your state's Act and prescribed form where an official page was read, and says to check locally where not.

Who signs

The employer (owner, partner, director or authorised person) signs the declaration and the verification.

Clause guide

Each part of the document in simple words.

Who makes the declaration
The owner, a partner, a director or someone authorised in writing. The person is described the way Indian affidavits do: name, relation, faith, occupation, nationality and address.
State and form
Choose your state above. The format names the state's Shops and Establishments Act and the prescribed form where an official page was read, and otherwise tells you to check with your local labour office.
Workers, holiday and hours
Count part-time and contract workers too. Many states exempt very small establishments or only need an intimation: your labour office will say which applies.
Verification
The last paragraph repeats that the contents are true. Notarisation is not always needed: ask the office that will receive it.
Mistakes to avoid
A wrong address or worker count, no holiday stated, and signing before you reach the notary if one is needed.

Common questions

Is a declaration compulsory for Shops Act registration?
Not in every state. Some labour offices ask for one with the application and others do not. Ask the office or check its portal.
Does it need stamp paper or a notary?
Plain paper is usually enough, but some offices ask for a notarised declaration or a small value stamp paper. Check with the labour office.
Which Act does it refer to?
Choose your state in the form: the document names your state's Shops and Establishments Act where an official page was read, and says to check locally where it was not.
Is this document reviewed by an advocate?
No. Check it with the issuing office before you sign.
What is a Shops Act declaration used for?
Use it when the labour department asks for a declaration or undertaking with the Shops and Establishments registration or intimation. The employer (owner, partner or director) signs it.
What documents go with the Shop Act declaration?
The owner's ID and address proof, proof of the premises (ownership proof or a rent agreement with the landlord's NOC), a photo of the owner and any list of workers the form asks for.
Is this the official Shop Act form?
No. It is a sample, not an official form. Offices differ, so check the text with the issuing office and use the office's own form if it gives you one.
Can I download the Shops Act declaration as Word or PDF?
Yes. Fill in the form, then download it as Word or PDF, print it or copy the text. What you type stays in your browser and is never sent anywhere.
