  • Ownership proof of the property (latest property tax receipt or sale deed copy)
  • Two witnesses with ID proof

Stamp duty and registration

A rent agreement is usually made on stamp paper or e-stamp, and the value depends on your state. A lease of more than one year must be registered under the Registration Act, 1908. Some states and cities also want shorter agreements registered or recorded, or ask for police verification of the tenant. Check with the Sub-Registrar office.

Stamp duty depends on your state and on the document. We do not show an amount here, because it changes and differs by state. Check it on the official portal of your state's registration department. Portals we found on government sites (checked 21 Oct 2026):

For any other state, check stamp duty with your state's registration department.

How to execute this document

  • Stamp paper: The value depends on your state and on the document. See the stamp duty calculators for official rates. Stamp duty calculators
  • Notarisation: Often done for the record, but it does not replace registration where the law requires registration.
  • Registration: An agreement for 11 months is usually not registered. A lease for more than 1 year must be registered (Registration Act, 1908, section 17).
  • Who signs: The owner and the tenant sign every page or at least the last page. Two witnesses also sign.
  • Witnesses: 2 adults who see you sign. Each writes name, address and signature.
  • ID and photos: Carry original ID and a recent photo of every person who signs. Never write an Aadhaar number on the document.
  • Where to submit: Keep it with the parties. Take it to the Sub-Registrar office if it must be registered.

Common mistakes

  • Signing before the stamp paper is bought or before the registration slot.
  • Names or spellings that do not match the ID.
  • Leaving any blank line or a missing witness address.
  • Not registering a document that the law says must be registered.

Common questions

Why are rent agreements made for 11 months?
A lease of more than one year must be registered, which costs more. Many people therefore sign an 11 month agreement and renew it. Some states and cities still ask for even a short agreement to be registered, so check with the Sub-Registrar office.
Does the tenant need a rent agreement as address proof?
A registered or stamped rent agreement is accepted as address proof by many offices and banks. Some offices also ask for the latest electricity bill or the owner's NOC.
Who keeps the original?
Usually each side keeps one original signed copy. Make at least two copies and have both signed.
