Reply to GST show cause notice format (Section 73 / 74, DRC-06)

Reply to a GST show cause notice for demand of tax, with grounds and a request for a personal hearing, prayer, verification and annexures.

What it is for

Use it when you receive a show cause notice for tax, interest or penalty under section 73 or section 74 of the CGST Act, 2017 (CBIC Instruction No. 02/2022-GST names sections 73 and 74 as the route for determining tax). The form and rule for the reply, and the time, are written in your notice: Section/form reference to be confirmed by your CA. Check the date on the notice before you do anything else.

Who signs

The proprietor, partner or director signs, or a person authorised in writing signs for the business.

  • Who signs: The proprietor, partner or director signs, or a person authorised in writing signs for the business.
  • Witnesses: none needed unless the office asks.

Common mistakes

  • Replying after the date in the notice without asking for more time.
  • Copying a section or case name you have not checked.
  • A point in the notice left without a reply.
  • Attaching documents that do not match the figures in the reply.
  • Filing without a CA or advocate looking at it.

Common questions

Is this format enough to file my reply?
No. It is a format. Notices have strict deadlines and every point must match your records. Get a CA or advocate to review your reply before you file it.
Where do I get the section and form numbers?
Copy them from your notice. This page does not quote a section number it has not checked. Where it is not checked, the format says: Section/form reference to be confirmed by your CA.
What if I cannot reply by the date in the notice?
Write to the officer before the date and ask for more time, with the reason. The adjournment request format on this site can be used for that.

Aksar pooche jaane wale sawaal

Yahi jaankari, Hinglish mein.

Kya ye format bhar dene se reply ho jata hai?
Nahi. Ye sirf format hai. Notice ki tareekh ka dhyan rakhein aur reply file karne se pehle apne CA ya advocate se check karwayein.
